1. Introduction

Welcome to bg.masterplusglobal.com (the “Site”). These Terms and Conditions (“Terms”) govern the relationship between STO PLUS MEDICAL LTD. EOOD, a company registered under the laws of Bulgaria, Unified Identification Code (EIK): 206896866, VAT Number: BG206896866 (hereinafter “We”, “Us”, or the “Company”), and any individual or entity (hereinafter “You” or the “Customer”) making a purchase or using our Site.

By accessing this Site and placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. General Provisions

2.1. The Customer confirms that they are at least 18 years of age and legally capable of entering into binding contracts.
2.2. These Terms set out the conditions for concluding a distance sales contract between the Company and the Customer under applicable Bulgarian law and mandatory EU consumer protection rules. The placement of an order by the Customer constitutes an offer to purchase under these Terms, and the contract is concluded in accordance with Section 4 below.
2.3. The Company reserves the right to update or modify these Terms at any time without prior notice. The Terms applicable to your order are those in force at the time of purchase. Mandatory consumer rights under Bulgarian and EU law are not affected.

3. Product Nature & Medical Disclaimer (Important)

3.1. Wellness Devices: The products sold on this Site (including bioceramic mats, thermal belts, massagers, and accessories) are non-invasive wellness and relaxation devices.
3.2. No Medical Claims: While our products are designed to promote general well-being and comfort, improve local comfort sensations, and provide muscle relaxation, they are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
3.3. Consult a Doctor: Information provided on this Site is for educational purposes only and is not a substitute for professional medical advice. Always consult a physician before using heated or massage devices, especially if you have pre-existing conditions (e.g., pregnancy, implants, acute inflammation, or cardiovascular issues).
3.4. Limitation of Liability: The Company is not liable for any health complications arising from misuse of the products, use contrary to instructions, or failure to consult a medical professional when appropriate. This clause does not limit or exclude any mandatory rights you may have under Bulgarian or EU law (including statutory product liability and consumer rights).

4. Ordering Process

4.1. The display of products on the Site is an invitation to treat, not a binding offer.
4.2. To place an order, you must add items to your cart and proceed to checkout, providing accurate contact and shipping details.
4.3. The contract is formed only when we send you an Order Confirmation email or when the goods are dispatched. We reserve the right to cancel any order for reasons including stock unavailability or suspicion of fraud.

5. Prices and Payment

5.1. All prices are indicated in EUR (Euro) unless otherwise displayed. Where applicable, prices include Bulgarian VAT unless stated otherwise.
5.2. We accept payments via VISA / Mastercard and other methods displayed at checkout (including, where available, bank transfer).
5.3. Payment is processed via a secure third-party payment gateway. The Company does not store your full credit card details.
5.4. Full payment must be received before the goods are dispatched, unless an alternative payment method is expressly offered at checkout.

6. Delivery

6.1. We deliver products throughout Bulgaria and within the European Union, if applicable.
6.2. Estimated delivery times are provided for reference only. We are not liable for delays caused by the courier service or force majeure events.
6.3. The risk of loss or damage to the goods passes to you when you, or a third party indicated by you (other than the carrier), acquire physical possession of the goods. If you choose a carrier that is not offered by us, risk passes upon handover of the goods to that carrier.
6.4. Please inspect the package upon delivery. If the packaging is visibly damaged, you should note this on the delivery receipt or refuse the package, and contact us as soon as possible.

7. Returns and Right of Withdrawal

7.1. Your right to return products and, where applicable, your statutory right of withdrawal for distance contracts (including the standard 14-day cooling-off period) are governed by our Refund and Returns Policy, which is an integral part of these Terms.
7.2. Hygiene Exception: Please note that due to health protection and hygiene reasons, sealed goods (such as eye masks, pillows, body belts, etc.) cannot be returned if the seal has been broken after delivery, where such an exception is permitted by applicable Bulgarian and EU consumer protection law.

8. Warranty (Guarantee)

8.1. We provide a commercial warranty for our electronic and bioceramic devices, where stated. This is in addition to, and does not affect, your mandatory legal guarantee rights.

  • Legal Guarantee Period: In accordance with applicable Bulgarian and EU consumer law, goods sold on this Site are covered by a mandatory legal guarantee of conformity for a period of 2 years (24 months) from the date of delivery.
    8.2. The legal guarantee covers lack of conformity that exists at the time of delivery and becomes apparent within the legal guarantee period.
    8.3. Exclusions: The legal guarantee does not cover:
  • Normal wear and tear.
  • Damage caused by misuse, dropping, liquid damage, improper care, or unauthorized repair.
  • Cosmetic damage (scratches, dents).
    8.4. To claim a remedy under the legal guarantee or any stated commercial warranty, you must provide proof of purchase (receipt/invoice).
    8.5 Burden of Proof:
  • First 12 Months: Any lack of conformity which becomes apparent within 12 months of delivery of the goods shall be presumed to have existed at the time of delivery, unless proved otherwise.
  • After 12 Months: For the remaining period (from the 13th month up to 2 years), the burden of proof may be on the Customer to demonstrate that the lack of conformity existed at the time of delivery (e.g., a manufacturing defect).
    8.6. Remedies: In case of a lack of conformity, the Customer is entitled to have the goods brought into conformity free of charge by repair or replacement. If repair or replacement is impossible or disproportionate, the Customer may request a price reduction or withdraw from the contract, in accordance with applicable law.

9. Intellectual Property

9.1. All content on this Site (images, text, logos, product descriptions) is the property of the Company or its licensors and is protected by copyright and related laws. You may not use, reproduce, or distribute any content without our prior written permission.

10. Governing Law and Dispute Resolution

10.1. These Terms are governed by the laws of Bulgaria and applicable mandatory EU consumer protection rules.
10.2. In the event of a dispute, the parties shall attempt to resolve it amicably through negotiation.
10.3. If a settlement cannot be reached, the dispute shall be submitted to the competent courts of the Republic of Bulgaria.
